The Service must not be used for any illegal or unauthorized activities, including but not limited to copyright or trademark infringement or any other violation of any Federal, state, or local law or regulation. By using the Service, you affirm that you are at least eighteen (18) years old and have not had your Account terminated or been previously suspended or removed from the Service.If you suspect that your account's security has been compromised, you must immediately inform us at info@getboostsocial.com.

As long as you comply with these Terms, Boost Social grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable permission to access and use the Service for your personal, internal use only.

2. Pricing and Payment Policy

Prices vary based on the selected plan and additional features. Pricing is based on your geographical location, determined by your IP address, business location, or phone number's country code. We reserve the right to change prices, and it is your responsibility to stay informed via our billing page at https://www.getboostsocial.com/billing. Promotional offers with different features and pricing may be available and are applicable only if specifically offered to you.

Recurring Payments:

Boost Social automatically charges for the subscribed product. Billing occurs on the due date for each subscription period. Billing will occur every month from your initial sign up date until canceled.

3. Cancellation & Refund Policy

Canceling any Service early does not guarantee a refund or credit of any kind.

Monthly Subscription Plan:

Cancellations must be processed through your Stripe Billing Page or send an email to info@getboostsocial.com. A User wishing to cancel their Service must ensure that the cancellation procedures are completed correctly to receive a 'Subscription Cancellation Successful' message. Please check the email you used to sign up for your account to create your account or change your subscription status. Please contact our support for any billing concerns before initiating a chargeback with your bank. This ensures quicker resolution and will help avoid credit history impacts. 4. How to cancel your subscription:

Visit your Stripe Customer Portal which can be found at https://billing.stripe.com/p/login/bIYdRc2TM4Id4SY5kk.

Enter the email you used to sign up for your subscription.

Then click on the “Cancel” button.

Follow the on-screen instructions to complete the cancellation process until you see "Subscription Cancellation Successful".

We will send you an e-mail proof of cancellation for your records, and access to the Service will no longer be available. Please ensure you follow the cancellation procedure correctly and receive a 'Subscription Cancellation Successful' message to confirm cancellation. If you have any queries or encounter any issues during cancellation, we strongly encourage you to send us an e-mail to: info@getboostsocial.com Please note that we will first attempt to retain you by offering a free 1-on-1 setup call. If you still wish to proceed with the cancellation, we will present you with some exclusive discount offers to make you stay. Only after you continue with the cancellation, will you receive a 'Subscription Cancellation Successful' message, marking the completion of the process.

5. User Responsibilities

Staying Informed: You should regularly check our Terms of Service and Privacy Policy. Continuing to use our Service after updates to these Terms and other disclosures signifies your acceptance of those changes. We will always try our best to notify you of major updates to policies.

It's important to delete data from such devices after use. Boost Social assumes no responsibility or liability for the use of the Service on non-personal or multi-user devices.

Prohibited Uses: You agree not to use the Service for data scraping, generating fake engagement, or any activities that violate the terms of service, policies, or guidelines of any social media platforms to which you belong or hold an account.

It accesses only the data you have permission to view via your social media account and settings, without tapping into additional non-permitted information.

Data Handling and Privacy:

Limited data such as posts may be temporarily cached in your browser to support productivity features without re-fetching data. This data is inaccessible to Boost Social and is automatically deleted after your browsing session to protect privacy. We are not responsible for the content displayed on or transmitted by these external sites.

7. Responsibility for AI Generated Content

Scope of Responsibility: While AI content generation feature, it is important to note that Boost Social is not responsible for any content generated, including text, images, and videos by AI models and 3rd-party services.

Generated Content: Any text, images, or videos that appear as a result of using our Service is the result of individual social media platform algorithms and user permissions. Boost Social does not control or influence the generation of this content.

User Discretion Advised: Users should exercise their discretion while interacting with content surfaced through our AI features. Boost Social assumes no liability for any outcomes resulting from the interaction with or reliance on such generated content.

Your Responsibility and Indemnification: You are strictly responsible for your use of the Service. Service Limitations: Boost Social does not guarantee that the Service will be uninterrupted, error-free, or secure. Boost Social is not responsible and will not be held liable for any service interruptions, errors, viruses, malware, or other harmful components.

Use at Own Risk: Your use of the Service is at your own risk. You are encouraged to secure and routeinely back up your important data and information. Boost Social is not responsible for any damage to your devices or loss of data resulting from your use of the Service.

Arbitration Agreement: You agree that any dispute related to your use of the Service or these Terms will be resolved through binding arbitration in Maricopa County, Arizona, not in a court of law. By agreeing to these Terms, you waive the right to a jury trial or to participate in a class action lawsuit or class arbitration and submit to the jurisdiction of the courts and abitral forums of the State of Arizona. Legal Compliance: Access to the Service is restricted for residents, citizens, and businesses from certain countries in compliance with U.S. law.

11. Consent to Receive Communications

By accepting these terms, you consent to Boost Social sending you product updates, feature notifications, billing and essential communications via SMS, WhatsApp, e-mail, and by post. Please ensure your Account contact details are accurate at all times. To opt-out of such messages, follow the instructions within the communication or contact us. Opting out may affect some Service features.

12. Account Restrictions and Limitations

By using the Service, you acknowledge and agree that third-party platforms, including but not limited to Facebook, Nextdoor, Instagram, Twitter, Reddit, LinkedIn, and other websites used for automation, may limit, restrict access, or suspend your account due to excessive activity. This is a result of these platforms' automated systems designed to protect the integrity of their services and is beyond our control.

These restrictions are typically temporary, some may last 24 or more hours. During this time, you may be unable to use certain features of our extension and/or the platform. We recommend that you use our extension responsibly and avoid excessive activity that could trigger these restrictions.

Boost Social is not responsible for any actions taken by third-party platform including but not limited to Facebook, Instagram, Twitter, Reddit, LinkedIn, and other websites use by the extension, such as account suspensions, restrictions, or other penalties. By using our Service, you fully assume all risk (or damage) associated with its use and agree not to hold, or attempt to hold, Boost Social liable under any cause of action, claim, or theory of liability or damages of any kind arising from its use.

13. Governing Law

These Terms and your use of the Service shall be governed by the laws of the State of Arizona in the United States of America without regard to conflict of law principles.

Arbitration notice

You agree that disputes arising under these Terms will be resolved by binding, individual arbitration, and BY ACCEPTING THESE TERMS, YOU AND BOOST SOCIAL ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract (except for matters that may be taken to small claims court). Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury.

14. International Use and Compliance with US Laws

Boost Social adheres to the laws and regulations of the United States, including trade sanctions and embargoes. Consequently, our services are not available in countries currently under sanctions by the U.S. government.

By using Boost Social, you affirm that you are not located in, under the control of, or a national or resident of any country under U.S. government sanctions or embargoes.
